1. Introduction
In NS 8407 Chapter II we find the rules on the parties and their assistants. The rules found in this chapter are distributed slightly differently in NS 8405 which has a somewhat different chapter division, while NS 8406 has no chapter division whatsoever. As previously pointed out, NS 8407 is most often used in projects as of today, which is why we take this standard as a starting point.
2. Overview of the rules
3. Brief presentation
We have written our own articles on “Representatives of the Parties” and if “Contract Assistants”.
It is these two topics that we have learned from experience that create the most uncertainty.
This does not mean that transport cannot create difficulties, but from experience the parties are quite used to the fact that transport takes place and one knows how to deal with it.
When it comes to site management, it is rare today for a builder to enter into a contract with several side contractors where one of these is charged with managing the others. This happens primarily in the section under the main or general contractor, namely with the subcontractors. We therefore write more about this in the articles on the subcontracting standards.
In addition, it is emphasized that in NS 8407 paragraph 11 and NS 8405 paragraph 4, namely that neither party to a contract of construction has the opportunity to assign its contractual obligations without this having been specifically agreed between the parties. This prohibition does not apply to the transfer of shares in a limited company, fission or merger.
